The Colorado Division of Securities Provides Revised Regulatory Guidance for Ongoing Financial Planners

November 15, 2022 -- The Colorado Division of Securities (the “Division”) recently published a revised “Ongoing Financial Planning Guide.”  This revised Guide includes updates and clarifications to the original version published in March 2022.  Additionally, the Division staff issued a letter accompanying the revised Guide that addresses industry comments and offers context to the Guide clarifications.

The purpose of the Guide is to assist investment advisers offering ongoing financial planning services by sharing recommendations and regulatory best practices observed by the Division exam staff. The staff published the guidance in response to the growing trend of advisers offering financial planning under an ongoing or continuous model, and the increasing need for advisers to review and enhance their compliance programs in this area.

Examinations serve to protect investors by ensuring that advisers are following the Colorado laws and rules that govern them. The guidance is not meant to cover all compliance areas.
